OSHA Withdraws COVID-19 Emergency Temporary Standard Applicable to Private Employers with More than 100 Employees

And . . . it looks like we’re at the end of the line for the U.S. Occupational and Health Administration’s (OSHA) COVID-19 Emergency Temporary Standard (ETS). Following the U.S. Supreme Court’s January 13, 2022 stay of the ETS , which would have required that private employers with more than 100 employees implement mandatory vaccine and testing protocols, OSHA announced on January 25, 2022 that it was withdrawing the ETS effective January 26, 2022.
