Attention D-40 Service Station Equipment Maintenance Contractors!

As many of you know, the California Contractors State License Board, in addition to issuing Class A General Engineering, Class B General Contractor, and Class C Specialty Contractor licenses, also issues several Class C-61 Limited Specialty Contractor licenses with a “D” designation. Among those is the Class C-61/D-40 Service Station Equipment Maintenance Contractor license.

According to the regulatory “note” describing the work that can be performed by a D-40 license holder, D-40 Service Station Equipment Maintenance Contractors who obtained their D-40 licenses after January 18, 2001, are only permitted to perform “calibration work.” The CSLB has issued the following bulletin further clarifying the kinds of “calibration work” a D-40 Contractor can perform:

CSLB Clarifies “Note” on C-61/D-40 Classification Description

The Contractors State License Board (CSLB) is reaching out to C-61/D-40 Service Station Equipment Maintenance contractors to further clarify a “note” in the classification description.

The note provides that licensees holding a D-40 classification issued after January 18, 2001, may perform only the “calibration” work described in the D-40 classification description itself. This description provides that calibration work includes, but is not limited to, “the testing and adjustment of leak detection and vapor recovery equipment, such as automatic tank gauges, leak line detectors, vapor recovery lines, and in-station diagnostics.”

According to the note in the classification description, those holding D-40 licenses issued after January 18, 2001, cannot install or remove incidental tank-related piping, electrical work, or install vapor probes in tank backfill areas. However, they can perform “calibration work” associated with these systems, which includes, but is not limited to the testing, adjustment, and diagnostics related to their proper functioning. CSLB considers “calibration” to include the installation, repair, and/or adjustment of components that are necessary for the calibration of an existing system.
