Blueprints

The idea behind “Blueprints” was to provide a series of “how to” guides on California construction laws. Check back periodically as we will be adding more Blueprints as time allows.  And, for you history buffs, here’s an interesting read on the history of blueprints from the New York Historical Society.

Hello, I’m a homeowner that hired a general contractor to built an ADU on my private residential property. This was in 2021-2022, the GC stopped work in Nov 2022. GC agreed to reimburse me $30k for overpayments on the job and for unfinished work including bad workmanship. So far they’ve only paid $12k and is struggling to pay the balance. They only pay $500/mo which is too long to pay off. I want to know if I should file claims against their bond companies to recover the $15k, and cut losses on the $3k. During our contract periods, GC had two bond companies with expirations of 2/25/22 and 1/1/23. What is the statute of limitations for me to file a bond claim? Do I need to file with both companies? Thank you.

Hi Kel. The deadline to file a claim against a license bond is 2 years from expiration of the bond. As to whether you can file against both bonds, it depends on whether the claims arose during the period that both bonds were in place.
